1. Agreement to terms

These terms apply when you use the TFH Site Direct website (www.sitedirect.com.au) and when you buy from us. By placing an order you agree to the terms on this page as they stand at the time you order. Site Direct is a trading name of TFH Hire Services Pty Ltd (ABN 30 063 810 679) ("we", "us", "our").

2. Use of the website

You must use this website only for lawful purposes. You must not use it in any way that breaches any applicable Australian law or that could damage, disable, or impair the site or any other user's access.

Product images and descriptions are for illustration. We work to keep descriptions and prices accurate, and we may correct errors and change or withdraw products on the website at any time. A correction never changes an order we have already accepted except as clause 3 explains.

3. Orders and acceptance

When you press Place order, you offer to buy the items in your order at the prices shown at checkout. We accept your offer, and a contract is made, when we confirm the order and take payment:

• Card: when your payment goes through and we show your order confirmation.
• Bank transfer: when your payment reaches our account and we confirm the order by email. Until then, the order is reserved but not accepted.

Before we accept, we may decline an order, for example if an item is out of stock or we suspect fraud. If we decline, we refund in full anything you have paid.

If, after we accept, we find that an item cannot be supplied or that a price on the website was obviously wrong, we will contact you. You can choose to go ahead (at the correct price, where it was a pricing error) or to cancel that item for a full refund of what you paid for it.

4. Pricing and payment

• All prices are in Australian dollars (AUD).
• Product prices are shown ex GST and inc GST. The order total you pay includes GST.
• Delivery is priced at checkout, or quoted before we charge it. The Shipping and Delivery Policy explains how.
• The prices that apply to your order are the ones shown at checkout when you place it. A later price change does not affect your order.
• Card payments are taken at checkout, when you place the order.
• Bank transfer orders are held for 5 business days from the day you order. If payment has not reached us by then, we cancel the order, tell you by email and release the goods. Nothing is owing on a cancelled order.

5. Shipping, delivery, risk and ownership

Delivery and pickup work as set out in our Shipping and Delivery Policy. Risk in the goods passes to you on delivery (or on collection if you choose pickup). Ownership passes to you once we have received payment in full.

6. Returns and refunds

Our Return and Refund Policy applies to all purchases. It sits alongside your rights under the Australian Consumer Law and does not limit them.

7. Consumer guarantees and liability

7.1 Your rights under the Australian Consumer Law. Our goods come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the goods repaired or replaced if the goods fail to be of acceptable quality and the failure does not amount to a major failure.

7.2 Nothing here takes those rights away. Nothing in these terms excludes, restricts or changes any right or remedy you have under the Australian Consumer Law, or any other law, that cannot lawfully be excluded, restricted or changed.

7.3 Business buyers only. Clause 7.3 applies only if you buy as a business and are not a consumer under the Australian Consumer Law for that order. It never applies to a consumer. For business buyers, and only to the extent the law allows:

• where the goods are not of a kind ordinarily bought for personal, domestic or household use, our liability for failing to meet a consumer guarantee is limited, at our choice, to replacing or repairing the goods, supplying equivalent goods, or paying the cost of replacing or repairing them;
• otherwise, our total liability for any claim arising from an order is limited to the amount paid for the goods the claim is about; and
• we are not liable for indirect or consequential loss, such as lost profit or delay costs on a job.

8. Intellectual property

All content on this website (including text, logos, images, and design) is owned by TFH or its licensors and is protected by copyright and other intellectual property laws. You may not copy, reproduce, or use it for commercial purposes without our prior written consent.

9. Privacy

Your use of the website and any personal information you provide are governed by our Privacy Policy.

10. Changes to these terms

We may update these terms from time to time and will post the new version on this page with a new "Last updated" date. A change applies only to orders placed after it is posted. An order you have already placed stays under the terms that applied when you placed it, and we will email you a copy of those terms on request.
